APPLICATIONS OF THE GENERAL CONDITIONS OF SALE

The general terms and conditions of sale, hereinafter referred to as "GTC", detailed below apply to all orders for products and services placed via the Site (the "Products") with the company NAD YUTH by any person (hereinafter referred to as the "Client").

The Client must be aware of the GTC before any order (the "Order"), as the GTC are available on the Site.

The GTC are subject to modifications and updates. They are permanently accessible from the homepage of the Site. Each order placed on the Site is subject to the GTC in effect on the day the order is placed. Consequently, placing an Order requires the Client's full prior and unreserved adherence to the GTC by clicking on the "I have read and accept the general terms and conditions of sale" button.

 

PRODUCTS

The products offered for sale are those presented on the Site within the limits of available stocks.

NAD YUHT takes great care in the presentation and description of products to best inform the Clients. However, errors may appear on the Site, which the Client acknowledges and accepts.

In the event that a product is unavailable after placing an order, the Client will be informed by email as soon as possible. The total amount paid by the Client for the purchase of this product will be directly credited back to their bank account.

It is possible that the Client receives, following an Order, a piece previously returned by another person. It is specified that NAD YUHT only accepts the return of intact Products, this condition being checked before the returned Products are restocked.

 

 

ORDERS

The placing of Orders on the Site is subject to compliance with the procedure established by NAD YUHT on the Site, including successive steps leading to the validation of the Order.

The Client may select as many Products as they wish, which will be added to the basket (hereinafter referred to as the "Basket"). The Basket summarizes the Products chosen by the Client, as well as the prices and associated fees. The Client can freely modify the Basket before validating their Order. Validation of the Order constitutes confirmation of the Client's acceptance of the GTC, the purchased Products, their price, and associated fees.

The Client expressly undertakes to provide complete and accurate information. In the event of an error in the wording of the delivery address or incomplete information making it impossible to deliver an order, NAD YUHT cannot be held responsible.

A confirmation email summarizing the Order will be sent to the Client by NAD YUHT. For this purpose, the Client formally accepts the use of email for the confirmation by NAD YUHT of the content of their Order.

 

 

REFUSAL TO PROCESS AN ORDER

NAD YUHT reserves the right to withdraw any Product displayed on the Site at any time and to replace or modify any content or information on it. Despite NAD YUHT's best efforts to satisfy its Clients' expectations, it may refuse to process an Order after sending the Client the confirmation email summarizing the Order.

NAD YUHT cannot be held responsible towards the Client or any third party for the consequences of the withdrawal of a Product from the Site, or for the replacement or modification of any content or information on this Site, or for the refusal to process an Order after sending the email confirmation summarizing the Order.

NAD YUHT also reserves the right to refuse or cancel an Order from a Client with whom it has a dispute over the payment of a previous order.

 

 

PRICES AND PAYMENT TERMS

The prices displayed on the Site are indicated in euros, including all French taxes (French VAT and other potentially applicable taxes), excluding shipping costs, contribution to order processing fees, and packaging fees.

The prices are firm, without discount, reduction, or rebate.

These prices may be modified at any time by NAD YUHT. The prices displayed are valid only on the day of the order and do not have effect for the future. The price applicable to the CLIENT is the one in effect at the time of the order.

Shipping costs, contribution to order processing fees, and packaging fees will be indicated in the CLIENT's basket, before the final validation of the order.

The Client expressly acknowledges that providing their bank card number to NAD YUHT constitutes authorization to debit their Account up to the price of the ordered Products. If applicable, a cancellation notification of the Order for non-payment is sent to the Client by NAD YUHT to the email address provided by the Client during their registration on the Site.

The data recorded and kept by NAD YUHT constitute proof of the Order and all past sales.

Payment is made online by one of the following methods: Carte Bleue, Visa, MasterCard, or Paypal. Payments are made through the secure system Stripe, which uses SSL (Secure Socket Layer) protocol, so that the information transmitted is encrypted by software and no third party can become aware of it during transmission over the network.

The buyer's account will be debited after validation of the order at the rate of the ordered products.

At the buyer's request, an invoice showing VAT will be sent to them.

 

MULTIPLE PAYMENTS WITH ALMA

Deferred/multiple payments are available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Amount of purchases

  • P3X: Only purchases between €150 and €2,000 are eligible for payment with Alma.

Fees

When paying in installments with Alma, the Client does not pay any fees.

Alma is a telepayment manager and issues an electronic certificate which will constitute proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the civil code.

Termination

Any termination of the GTC binding the Seller and the client leads to the termination of the GCU between Alma and the client.

 

DELIVERY

Delivery is carried out at the delivery address indicated by the Client, it being specified that this must be the address of residence of the Client, a physical person of their choice, or a legal entity (delivery to their company). Delivery cannot be made to hotels or PO boxes.

NAD YUHT undertakes to make its best efforts to deliver the ordered products within the time limits indicated at the time of the order confirmation. In order for these deadlines to be respected, the Client must ensure that they have communicated accurate and complete information concerning the delivery address.

The Client will be informed by email as soon as possible of any eventual delivery delay. In such a situation, they will also be informed by email of the new delivery times.

The products sold on the Site can only be delivered in the following countries: Metropolitan France, Monaco, and countries of the European Union. Possible delivery restrictions are indicated on the Site, on the product presentation page.

Delivery times vary depending on the availability of the ordered products, the place of delivery, and the chosen mode of delivery.

The products ordered on the Site will remain the property of NAD YUHT until their delivery to the address indicated by the Client. All risks associated with the ordered products (including the risks of loss and/or damage to the products) are transferred to the Client at the time of their delivery.

 

EXCHANGE AND REFUND - RIGHT OF WITHDRAWAL

In accordance with Article L.221-18 of the Consumer Code, the non-professional Client has a period of fourteen (14) days from the receipt of the Order to exercise their right of withdrawal from NAD YUHT, without having to justify their decision.

To exercise the right of withdrawal, the Client notifies NAD YUHT of their decision to withdraw from this contract by means of an email sent to bonjour@nadyut.com.

In the case where the return request is validated, NAD YUHT will then send an explanatory email of the return procedure.

The Product must be returned within a week in its original packaging, in its original condition, and accompanied by the invoice (or a copy) to the address indicated in the explanatory email of the return procedure.

The return is at the Client's risk according to the initial mode of sending. However, NAD YUHT suggests that the Client return their products by registered post or with additional insurance, guaranteeing, if necessary, compensation for the products up to their actual market value in case of loss or damage of this merchandise. For products that cannot be returned by conventional means due to their size, the return will be made according to the initial mode of sending. It is up to the Client to keep all proof of return. The return costs are at the expense of the Client, who is free to choose the mode of shipment.

In case of an error attributable to NAD YUHT (new defective item or error in order preparation), NAD YUHT will cover the return shipping costs of the item. The Client must send the carrier's invoice to NAD YUHT to obtain reimbursement.

If the item is not returned by the Client within a week after receiving the return authorization email, the return is considered canceled and the Client must keep the product.

The refund of the Order by NAD YUHT is made no later than fourteen (14) days from the date on which it is informed of the Client's decision to withdraw. However, the refund occurs provided that NAD YUHT has been able to recover the Products subject to the return and refund request.

NAD YUHT makes the refund using the same means of payment as the one used for the payment of the Order. If and only if the latter has expired, NAD YUHT will approach the Client to make the refund by another means of payment and provided that the refund does not incur additional costs for NAD YUHT. The refund of an order paid with an e-gift card, a gift card, or a credit note, will be automatically refunded in credit.

Personalized or custom-made products will not be taken back or exchanged.

 

 

RIGHT OF RETURN

In the event that the Products received are not in conformity with the order, the Customer has a right of return. In this case, they must contact customer service, who will indicate the return address and procedures.

NAD YUHT will exchange the damaged item, subject to available stock.

 

WARRANTIES AND LIABILITY

NAD YUHT strives to ensure the accuracy and updating of the information disseminated on this site to the best of its ability, and reserves the right to correct the content at any time and without notice. However, NAD YUHT cannot guarantee the accuracy, precision, or completeness of the information available on this site.

Therefore, NAD YUHT cannot be held liable for any inconvenience or damage inherent to the use of the internet network, including service interruption, external intrusion, or the presence of computer viruses, or any event qualified as force majeure, in accordance with the law and jurisprudence.

Similarly, NAD YUHT declines all responsibility for any inaccuracy or omission regarding information available on the site, any damages resulting from a fraudulent intrusion by a third party leading to a modification of the information made available on the site. This site may contain links to other sites. NAD YUHT cannot be held responsible for problems of access or content on these sites.

For some products, NAD YUHT is only an intermediary in the sale. Thus, in case of direct or indirect damages that could be caused by these products, the responsibility of the Seller should be engaged.

By registering on the Site, Customers agree to occasionally receive mail and newsletters from La Maison - Nad Yut.

 

NULLITY OF A CLAUSE

In the event that one or more clauses of these GTC are declared null and void by a court decision, such nullity shall not affect the validity of the remaining clauses, which shall continue to produce their effect.

 

APPLICABLE LAW

All of the GTC described above are subject to French law and are to be interpreted in French.

Disputes arising from the breach or execution of these GTC will be subject to the laws and jurisdictions in force and competent in France.
